Can a Heart Attack Increase the Likelihood of Benefits Approval?

If you’ve investigated disability benefits at all, you know that the Social Security Administration (SSA) rules for disability are strict. Even if you’re suffering from a serious heart condition, it may not be severe enough to grant you disability benefits. Depending on your condition, suffering from a heart attack may impact your eligibility for disability benefits, but it depends on your unique circumstances and the severity of your heart condition.

While nearly any heart condition has the potential to be disruptive, in order to qualify for disability benefits, your condition must be severe enough to prevent you from working for a continuous twelve (12) months. After experiencing a heart attack, many people regain much of their functional abilities within weeks, after going through treatment and possibly cardiac rehab. For that reason, a heart attack alone may not prevent you from working for long enough to meet the disability requirements.

However, it may be that after having a heart attack you experience even more limitations than before. If that’s the case, even if you didn’t qualify prior to your heart attack, you might now.

There are several other heart conditions that often precede a heart attack, such as coronary artery disease. Coronary artery disease is one of the leading precursors of a heart attack, but in order to qualify for benefits under this listing, you must have severe symptoms of ischemic heart disease, despite following prescribed treatments, or one of the following:

  1. Exercise intolerance; extreme fatigue after minimal exertion
  2. Three distinct episodes of vascular narrowing or blockages that have required surgical intervention, angioplasty, or catheterization
  3. A 50% to 70% reduction of a major coronary vessel, one that can’t be bypassed surgically

Cardiac conditions such as coronary artery disease can cause major disruptions to your work life, however if your symptoms are not severe enough to qualify for benefits prior to a heart attack, they might compound after experiencing a heart attack.

Applying for disability benefits takes a lot of work, but a lawyer who specializes in disability claims can assist you with submitting a thorough application, gathering evidence, and arguing eligibility through appeals, if necessary. Contact Molly Burke Law Office today to set up your free, no-obligation consultation. If you have a heart condition that is preventing you from working, we’d be happy to help you navigate through the Social Security disability process.

Molly Burke is an amazing Lawyer. I had fought my Social Security Disability case alone for yrs without a lawyer after I was wrongfully dropped from SS in 2017. I reached out on NOLO on Google expecting to not hear anything from any lawyers because of the reason I was being denied. Molly reached out to me and said she had fought other cases that were getting denied for the same reasons as me and said she'd love to help me. Molly always responded to my emails or texts immediately no matter when I reached out. She was there for me after my case was approved and fighting for my back pay that I still hadn't received 9 months after I won. I have never had someone fight for me or treat me like Molly has, so warm, caring and very professional. I seriously can't say enough good things about Molly, and have told her numerous times she truly is an angel and my whole family is forever greatfull that she decided to take on my case. I don't think 5 stars are enough for her and if I could give her more stars I would, but since I can't I would HIGHLY RECOMMEND MOLLY to everyone. I have actually already gave 2 people her name and number to reach out to her. Again, if you want someone to care about you and your case Molly is that Lawyer. My family can't thank her enough, but I will tell anyone who asks who I had as a lawyer I won't hesitate to recommend Molly. Thank you again Molly for helping me throughout my case and after my case. I will forever be in debt to you. If you want someone who will fight tooth and nail for you and your case call Molly, she's AMAZING.
Response from the owner:Thank you, Kristen! I'm so glad that we could get you some relief!

I literally got my SSDI approved in 7 months. If I didn’t have Molly for my attorney I’m not sure how long it would have taken. She went above and beyond, she was patient with me and answered all my questions (even on the weekends!) if you’re looking for an attorney that will get your SSDI approved in a timely manner, she’s who you want representing you. I would give her more than 5 stars if I could!
Response from the owner:Thank you, Lisa! I am so glad we got a good result!
